This Service Agreement (the "Agreement") contains the complete terms and conditions which govern your subscription of Web hosting, e-Commerce and other Internet-related services provided by Easy Link, (the "Services"). As used in this Agreement, "Easy Link" means Easy Link, and "Client", "you", or "your" means you. By clicking on the "Signup" button, you acknowledge that you have read the Agreement, and you agree to its terms and conditions and all policies posted on the Easy Link site. As referred to in this Agreement, "Site" refers to a World Wide Web site and "Easy Link" refers to the Site located at the URL http://www.EasyLinkServer.com, or any other successor Sites owned or maintained by Easy Link.

Client Content.
Client agrees that it will not distribute, electronically transmit or display any materials supplied by Client - or through Client by a third party - to any Easy Link' server in connection with Client's use of the Services which: violate any state, federal or foreign laws or regulations; infringe on any intellectual property rights (e.g., copyright, trademark, patent or other proprietary rights) of Easy Link or any third party; are defamatory, slanderous or trade libelous; are threatening or harassing; are discriminatory based on gender, race, age or promotes hate violate any Easy Link' policy posted on the Easy Link Site. You agree that you will not send malicious e-mails which contain viruses, spam, or other computer programming defects which result in damage to Phoenix Easy Link or any third party.

Usage:
Easy Link reserves the right to terminate any customer's service for spam/fraud related purposes and / or other illegal activities.

Clients are strictly prohibited from:
A) Sharing/uploading egg-drops, IRC bots, Warez materials, illegal scripts, copyrightable material such as mp3s, softwares, etc.
B) Utilizing the Services in any manner to interrupt or interfere with the Internet usage of other persons.
C) Utilizing the Services to copy material from third parties (including text, graphics, music, videos or other copyrightable material) without proper authorization.
D) Utilizing the Services to provide passwords or access codes to persons not authorized to receive such materials by the operator of the system requiring the password or access code, provide links to warez/mp3/hacking files/pages.

Any user found using excessive CPU load and/or memory RAM on server will first result in a warning then suspension.

Easy Link is not responsible and does not provide support for any 3rd party program/script/softwares.

Clients may utilize all the bandwidth and space issued to their account as granted by Easy Link, and we encourage you to do so, as long as the content of your account does not in any way violate these TOS.
No "SPAM":

Client shall not use the Services for chain letters, junk mail, spamming, or any use of distribution lists to any person who has not given specific permission to be included in such a process. Client also shall not engage in any unsolicited email practices at Easy Link, or otherwise, that mentions or reference any domain hosted on Easy Link servers or parked on Easy Link DNS servers. NOTE: THIS POLICY APPLIES TO EVERYONE THAT IS ON OUR SERVERS.

Licensed Software Only:
Client agrees to use only properly licensed third party software in connection with Client's use of the Services.

Termination:

Easy Link reserves the right to refuse service to anyone. Easy Link, in its sole discretion, may immediately terminate this agreement and/or service if Client engages in any of the foregoing. To report any unacceptable behavior by a third party using the Services, please contact [email protected] .
